WAIVER AND RELEASE OF LIABILITY   

In consideration of the risk of injury while participating in (Krav Maga, Kickboxing, Personal Training, Group Fitness), and as consideration for the right to participate in the Activity, I hereby, for myself, my heirs, executors, administrators, assigns, or personal representatives, knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights, claims or causes of action of any kind whatsoever arising out of my participation in the Activity, and do hereby release and forever discharge The Focus Group, LLC, located at 33 Dover St, Brockton, MA 02301, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, for any physical or psychological injury, including but not limited to illness, paralysis, death, damages, economical or emotional loss, that I may suffer as a direct result of my participation in the aforementioned Activity, including traveling to and from an event related to this Activity. 

 

I AM VOLUNTARILY PARTICIPATING IN THE AFOREMENTIONED ACTIVITY AND I AM PARTICIPATING IN THE ACTIVITY ENTIRELY AT MY OWN RISK. I AM AWARE OF THE RISKS ASSOCIATED WITH TRAVELING TO AND FROM AS WELL AS PARTICIPATING IN THIS ACTIVITY, WHICH MAY INCLUDE, BUT ARE NOT LIMITED TO, PHYSICAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, DISFIGUREMENT, TEMPORARY OR PERMANENT DISABILITY (INCLUDING PARALYSIS), ECONOMIC OR EMOTIONAL LOSS, AND DEATH. I UNDERSTAND THAT THESE INJURIES OR OUTCOMES MAY ARISE FROM MY OWN OR OTHERS' NEGLIGENCE, CONDITIONS RELATED TO TRAVEL, OR THE CONDITION OF THE ACTIVITY LOCATION(S). NONETHELESS, I ASSUME ALL RELATED RISKS, BOTH KNOWN OR UNKNOWN TO ME, OF MY PARTICIPATION IN THIS ACTIVITY, INCLUDING TRAVEL TO, FROM AND DURING THIS ACTIVITY.

 

I agree to indemnify and hold harmless against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs, if litigation arises pursuant to any claims made by me or by anyone else acting on my behalf. If incurs any of these types of expenses, I agree to reimburse The Focus Group, LLC.

The undersigned individual (the Member), hereby indicates their desire to become a member of Focus Fitness and Self Defense by New Focus, LLC, pursuant to the terms and conditions of this gym membership agreement.

The Member attests that they are fully able to participate in an exercise regimen of their design or choosing without undue risk.

The Member agrees to pay either monthly dues, indicated by selecting the option. These dues may be paid by automatic debit or credit card transaction or in-person via debit, credit, or cash.

This gym membership agreement entitles the member to access to Focus Fitness and Self Defense by New Focus, LLC facilities so long as all dues are current.

Personal training and cardio kickboxing are offered by the gym but are not included in the member’s membership dues. Focus Fitness and Self Defense by New Focus, LLC reserves the right to demand additional fees for any personal training and cardio kickboxing that the Member chooses to participate in.

This gym membership serves as a liability release, pursuant to which the Member agrees to indemnify and hold Focus Fitness and Self Defense by New Focus, LLC harmless against any and all claims of loss or damage without limitation.

The Member hereby agrees to abide by all posted safety guidelines and regulations while using Focus Fitness and Self Defense by New Focus, LLC facilities and equipment.  Additionally, the Member agrees to dress and conduct themselves in a manner deemed appropriate for a fitness facility.  The Member shall not consume drugs, alcohol, or tobacco products on Focus Fitness and Self Defense by New Focus, LLC property.  The Member agrees not to photograph or videotape on Focus Fitness and Self Defense by New Focus, LLC property.  Focus Fitness and Self Defense by New Focus, LLC reserves the right to revoke the Member’s access if these terms are violated.

This gym membership may be cancelled by providing written notice, in person, at Focus Fitness and Self Defense by New Focus, LLC. If the gym membership contract is cancelled prior to the 25th of the month, the Member agrees to pay a cancellation fee of $50.  If the Member must cancel this gym membership contract due to military service or relocation to an area more than 25 miles from a Focus Fitness and Self Defense by New Focus, LLC facility, the Member may cancel without paying the cancellation fee.

This gym membership contract shall be considered binding upon the Member and Focus Fitness and Self Defense by New Focus, LLC, and shall be upheld and enforced in accordance with the laws of Massachusetts. Any legal proceedings related to this gym membership contract shall take place in courts located in Brockton, Massachusetts.

The below signed parties hereby enter into this gym membership contract with one another in acknowledgement and acceptance of the terms listed above.
